What Products Are Approved in Texas?

As of September 1, 2025, Texas expanded its Compassionate Use Program (CUP) to broaden both the types of products available and the THC limits patients may access. Before this change, options were limited to low-THC tinctures, oils, and gummies, often leaving patients without effective alternatives. The new law increases flexibility by allowing additional delivery methods and higher THC content, giving patients more opportunities to find relief.

 

Key Updates Under the Expansion:

  • THC Limits: Prescriptions may now contain up to 10 milligrams of THC per dose, with each package capped at 1 gram of THC total.

  • Delivery Methods: Patients can now access not only ingestible products but also pulmonary inhalation devices (like nebulizers, inhalers, and vaporizers), but only if a CUP-registered physician determines it’s appropriate and prescribes it.

 

Gummies

THC-infused gummies are a discreet and easy way to take medical marijuana. They provide long-lasting relief but take time to work, usually between 30 minutes and 2 hours.

 

Tinctures

These liquid marijuana extracts are taken under the tongue (sublingually), allowing for quicker absorption. Tinctures are available in various strengths and allow for precise dosing.

 

Capsules

Capsules offer a convenient and consistent way to take medical marijuana. They provide a measured dose of THC, making them a good choice for patients who want simplicity and accuracy.

Topicals: Lotions, Patches, and Suppositories

Topical medical marijuana products are applied directly to the skin or mucous membranes, providing localized relief without strong psychoactive effects. Lotions and creams help with muscle or joint pain, while transdermal patches deliver controlled doses over time. Suppositories offer an alternative for targeted relief, giving patients more ways to manage symptoms alongside other products.

 

Nebulizers, Inhalers, and Vaporizers

For patients whose doctors recommend faster-acting relief, Texas now allows the use of certain pulmonary inhalation devices. These devices heat or aerosolize marijuana so patients can inhale it without combustion. Importantly, they are only available if specifically prescribed by a registered CUP physician.
