Retailers are mandated to verify government-issued identification at the point of sale, and failure to comply will result in the revocation of the retailer's license. Individuals under 21 can still access medical marijuana, but they must have a parent or legal guardian serve as their caregiver.

• Labeling and Testing Standards: The Texas Department of State Health Services (DSHS) is directed to review and potentially strengthen existing rules, including implementing stricter labeling and testing requirements. This aims to ensure that consumers are well-informed about the products they purchase and that products meet safety standards.

• Increased Enforcement and Licensing Fees: The executive order calls for enhanced coordination among state agencies, including DSHS, the Texas Alcoholic Beverage Commission (TABC), and the Department of Public Safety (DPS), to enforce new rules on THC product sales, such as stricter age limits, ID checks to prevent sales to minors, and tighter labeling and testing standards. Additionally, licensing fees for dispensaries may be increased to cover enforcement and oversight costs.

These measures are designed to protect minors, improve product safety, and maintain a regulated market for THC products in Texas.
