Texas is once again making headlines with new proposals that could reshape the state’s medical marijuana program. Expanding Qualifying Conditions
Texas has already expanded its medical marijuana program once this year. On September 1, 2025, new medical conditions were officially added, allowing more patients to access treatment under the Compassionate Use program.
Now, state health officials are reviewing proposals for future expansions, which would allow doctors to request additional conditions for approval. The process is still underway, and no new conditions from this proposal are official yet.
It’s important to remember that only licensed physicians can formally request the state to expand the list of qualifying conditions. Any updates must go through the official review process before patients can benefit.

Inhalation Devices on the Horizon

Minimum Age Requirement: The sale of THC products is now prohibited to individuals under the age of 21. Retailers are mandated to verify government-issued identification at the point of sale, and failure to comply will result in the revocation of the retailer's license. Individuals under 21 can still access medical marijuana, but they must have a parent or legal guardian serve as their caregiver.
Labeling and Testing Standards: The Texas Department of State Health Services (DSHS) is directed to review and potentially strengthen existing rules, including implementing stricter labeling and testing requirements. This aims to ensure that consumers are well-informed about the products they purchase and that products meet safety standards.
Increased Enforcement and Licensing Fees: The executive order calls for enhanced coordination among state agencies, including DSHS, the Texas Alcoholic Beverage Commission (TABC), and the Department of Public Safety (DPS), to enforce new rules on THC product sales, such as stricter age limits, ID checks to prevent sales to minors, and tighter labeling and testing standards. Additionally, licensing fees for dispensaries may be increased to cover enforcement and oversight costs.
These measures are designed to protect minors, improve product safety, and maintain a regulated market for THC products in Texas.
