Texas has taken another big step forward in expanding access to medical marijuana. The state’s Department of Public Safety (DPS) is now accepting new applications for medical marijuana dispensary licenses, while also updating the rules under the Compassionate Use Program (CUP). These changes could bring more treatment options to patients and provide much-needed relief for Texans with serious medical conditions.
What’s Changing in Texas?
The latest expansion of the Compassionate Use Program is focused on growing access in two key ways:
More Dispensaries Coming: DPS has opened the door for additional medical marijuana businesses to apply for licenses, which will increase availability across the state.
Expanded Qualifying Conditions: New rules give doctors more flexibility to recommend medical marijuana for conditions beyond the current list.
This expansion is a response to patient demand and advocacy efforts, particularly from veterans who say medical marijuana has helped them manage PTSD and chronic pain when other treatments failed. Many advocates argue that marijuana has “literally saved lives” by offering safe alternatives to opioids and other risky medications.
Who Qualifies for Medical Marijuana in Texas?
Under the Compassionate Use Program, patients must:
Be a permanent Texas resident
Have a qualifying medical condition approved by the state. Current qualifying medical conditions include epilepsy, cancer, PTSD, multiple sclerosis, autism, ALS, spasticity, and certain incurable neurodegenerative disorders
Receive a recommendation from a physician who is registered with the CUP
With the new rules, doctors will soon have more authority to recommend medical marijuana for conditions they believe are debilitating, even if those conditions aren’t explicitly listed by the state. This could make access much easier for thousands of Texans!
What Products Can Patients Currently Access?
Texas medical marijuana patients will be able to access products with higher THC content starting September 1, 2025, when House Bill 46 (HB 46) officially becomes law. Under the old rules, products were restricted to just 1% THC by weight, which made it difficult for many patients to find effective relief. The updated law will replace that limit with a more practical approach: each dose will be able to contain up to 10 milligrams of THC, and each package or device can hold a maximum of 1 gram of THC in total. While smokable flower and edibles will remain prohibited, this shift gives patients access to stronger, more effective treatment options in the form of tinctures, lozenges, and other low-THC products.
Why This Matters for Texans
For patients who have struggled to find relief with traditional medications, medical marijuana may provide a safer and more effective option. With more dispensaries opening and the list of conditions expanding, access is expected to improve significantly.
As one Texas veteran put it, marijuana has been a game-changer: “It literally saved my life.” These stories highlight why the Compassionate Use Program continues to gain support from both patients and lawmakers.

The Future of Medical Marijuana in Texas
Texas still has one of the most restrictive medical marijuana programs in the U.S., but recent updates show progress. More dispensaries and broader qualifying conditions could bring relief to thousands more patients.
