Texas Marijuana Progress: Applications Are Now Open for Medical Marijuana Dispensary Licenses

Texas is taking a major step toward expanding its medical marijuana program. The Department of Public Safety (DPS) has officially opened the application process for new dispensary licenses, marking a significant milestone in the state’s Compassionate Use Program. For existing applicants, the process requires updating their submissions by the deadline. Failure to meet the deadline will result in disqualification. These applicants will be notified by December 1, 2025, whether they have been awarded a license.


New dispensary applicants must submit a complete application along with the required fees by September 15, 2025. Those applications will be reviewed, and winners will be announced by April 1, 2026.


What This Means for Texas Patients

Texas still has one of the most restrictive medical marijuana programs in the country, with products limited to low-THC marijuana and only certain qualifying medical conditions eligible for treatment. However, the new legislation expanded the list of qualifying conditions to include chronic pain, traumatic brain injury, and terminal illnesses under hospice or palliative care.


Another important update is that dispensaries will now be allowed to operate satellite locations. This means patients will have more options for picking up their medicine without traveling long distances, especially in rural parts of the state.


Continued Policy Momentum

This expansion comes as part of a broader push for marijuana reform in Texas. While some proposals have stalled, such as a bill that would have banned hemp-derived THC products, the passing of this expansion shows lawmakers are moving toward more accessible medical marijuana policies.


The Texas Health and Human Services Commission has also posted draft rules that would allow physicians to recommend new qualifying conditions and establish guidelines for the use of inhalation devices. Once published in the Texas Register, a 31-day public comment period will be available for residents to share their input.
