Texas Medical Marijuana Laws Are Changing: What You Need to Know

Texas is at a pivotal moment when it comes to medical marijuana. With growing support from both lawmakers and the public, recent developments are laying the groundwork for expanded access to marijuana-based treatments. While the state still has one of the more restrictive programs in the country, progress is being made, and that means more options will soon be available for patients who need relief.

A Look at Texas’s Current Program

The Texas Compassionate Use Program, originally established in 2015, allows qualified patients to legally access low-THC cannabis products. As of now, products are limited to those containing no more than 1% THC by weight, and smokable forms are still prohibited. Approved methods include tinctures, capsules, and lozenges.

Currently, the list of qualifying conditions includes:

  • A seizure disorder

  • Multiple sclerosis

  • Epilepsy

  • Spasticity

  • Amyotrophic lateral sclerosis

  • Autism

  • Cancer

  • Post-traumatic stress disorder

  • An incurable neurodegenerative disease

In recent years, the state has taken steps to expand the list of eligible conditions and increase THC limits, signs that momentum is building toward a more robust program.

Legislative Momentum in 2025

Lawmakers are actively working to reform and modernize Texas’s medical cannabis laws. Earlier this year, bipartisan support emerged in favor of expanding the Texas Compassionate Use Program. Proposals under discussion include increasing the THC limit beyond 1%, broadening the list of qualifying conditions, and possibly legalizing additional product types. These changes could significantly improve access and treatment options for patients with chronic and debilitating conditions.

Public opinion continues to shift as well. Polls show that the majority of Texans support broader access to medical marijuana, and many legislators are responding to that demand with forward-thinking proposals aimed at updating the outdated framework of the Texas Compassionate Use Program.
